NUMBER ONE RULE…

BE KIND, RESPECTFUL, COURTEOUS & CAUTIOUS

Assumption of Risk. Renter acknowledges that the activities for which ALL ITEMS RENTED BY TIKI’S BIKES BOATS and BEACH, LLC. is designed for include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and ACCEPTS ALL LIABILITY AND RISKS with the use of ANY AND ALL RENTED ITEMS and assumes full and complete responsibility for said items during the rental period.

Acceptable Use. Renter agrees and acknowledges that he/she will be the sole responsible party for the use and care of the rented equipment and that it shall only be used for its intended uses and purposes, that all items shall be used in a careful, safe and conscientious manner. Renter shall always observe and adhere to any rules and guidelines posted by Company, and any applicable laws or regulations. The item(s) you are renting are designed to be used ONLY in approved areas. Use outside of approved areas could lead to run-ins with law enforcement, injury or death.

All Bikes are required to remain on designated bike paths, roadways and trails. You’re on vacation take your time enjoy the scenery and RELAX. Precautions should be made when using watercraft always know where you are and where you’re headed. When renting beach items please be aware that all items must be removed daily from the beaches prior to sunset. Please pay attention to weather forecast, high winds and changing weather patterns can occur quickly, please always secure all items. Please remember lost or stolen items will result in you paying for such items at full retail value.

 

Prohibited BIKE and E-Bike Activities. Renter shall not violate any of the following rules and regulations during his/her operation of the Bike:

  • There are no passengers permitted on any Bikes.
  • Our trails are here to provide a leisurely experience, please note maximum speed on all trails is 10MPH.
  • Please yield the right of way to all pedestrians and motorized vehicles.
  • Please be courteous to all fellow trail users, take your time and yield to others.
  • You must obey all traffic laws just as if you were driving a car.
  • There are hundreds of miles of paved bike trails in the South Baldwin County area use them. NO BIKE SHALL BE USED OFF-ROAD, ON THE BEACHES & DEFINITELY NOT IN THE WATER. VIOLATION OF THIS RULE MAY RESULT IN YOU PURCHASING THE BIKE AND\OR EQUIPMENT.
  • There are no alcoholic beverages permitted while using the Bike. Just as in a motorized vehicle Alabama State Law allows Law Enforcement Officers to charge you and take you to jail for driving under the influence.

 

Unsafe Use. If at any time Company determines that Renter has engaged in an unsafe or hazardous use of the Bike, Company may immediately terminate the rental. Upon notification of termination, Renter must return the Bike to a designated return area immediately. If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her rental amount and may be subject to further expenses or actions. Company shall determine, in its sole discretion, whether any behavior or activity is “unsafe or hazardous.”

Condition of Bike upon Return. The Renter shall return the Bike to the designated return area clean and in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to the Bike during the rental period. Renter may be billed by Company for the full amount of any and all damages caused by Renter during the rental period, including reasonable attorney’s fees if necessary.

ALABAMA STATE LAW:

Section 32-5A-284 Duties of person regularly engaged in business of renting bicycles. (a) A person regularly engaged in the business of renting bicycles shall require each person seeking to rent a bicycle to provide his or her signature either on the rental form or on a separate form indicating both of the following: (1) Receipt of a written explanation of the provisions of this article and the penalties for violations. (2) A statement concerning whether a person under the age of 16 years will operate the bicycle in an area where the use of a helmet is required. (b) A person regularly engaged in the business of renting bicycles shall provide a helmet to any person who will operate the bicycle in an area requiring a helmet, if the person does not already have a helmet in his or her possession. A reasonable fee may be charged for the helmet rental. (c) A person regularly engaged in the business of selling or renting bicycles who complies with this article shall not be liable in a civil action for damages for any physical injuries sustained by a bicycle operator or passenger as a result of the operator’s or passenger’s failure to wear a helmet or to wear a properly fitted or fastened helmet in violation of this article.

PONTOON BOAT USEAGE

Please note that PONTOON BOAT RENTALS are only for use with-in the confines of Little Lagoon in Gulf Shores. NO PONTOON BOAT SHALL CROSS SOUTHWARD OF THE LITTLE LAGOON PASS BRIDGE. NO PONTOON BOAT SHALL OPERATE IN THE GULF OF MEXICO. Please also note that if passing under ANY OTHER BRIDGES that all canopies must be lowered. ALL BRIDGES have low clearances. All canals are NO WAKE ZONES which means IDLE SPEED ONLY! All pontoon boats come with full tank of gas, you are responsible for any other fuel. FUEL SHALL BE ETHANOL-FREE ONLY available at the gas station at Walmart. Failure to do so could cause engine damage WHICH YOU will be responsible for. MINIMUM AGE FOR PONTOON RENTALS IS 25 YEARS OF AGE.

KAYAKS & PADDLEBOARDS

There are endless possibilities for kayaks and paddleboards, know where you are and where you are headed at all times. Know your limits keep in mind that where ever you are headed you are only half way, because you must return. Let someone in your party know where you are headed and when you will return. Make sure cell phones are in a waterproof case. If you get in trouble, call 911.

Due to High Demand and to provide the best customer experience, ALL RESERVATIONS require full payment to guarantee your reservation AT THE TIME THE RESERVATION IS MADE..

WHILE EVERY ATTEMPT WILL BE MADE TO PROVIDE YOU WITH THE EXACT ITEM YOU REQUESTED TIKI’S RESERVES THE RIGHT TO MAKE CHANGES IN ORDER TO BEST SERVE THE GUEST.

48 Hour Cancellation Policy

No refunds will be made to any reservations with less than a 48-hour notice. CANCELLATIONS ARE SUBJECT TO AN ADMINSTRATION CHARGE OF 20%. Cancellations must be made by contacting a TIKI Representative. No refunds are given for inclement weather UNLESS the coast is under a state ordered evacuation.
